HOMICIDIOS y ASESINATOS: Como evitar y combatir los delitos más graves y peligrosos
Las muertes intencionadas o causadas a propósito están tipificadas en los códigos penales de los diversos países, como asesinatos u homicidos dolosos y son castigados con la penalidad más elevada.
HOMICIDES and MURDERS: How to avoid and fight the most serious and dangerous crimes
Intentionally or intentionally caused deaths are typified in the criminal codes of the various countries, such as murders or intentional homicides and are punished with the highest penalty.
En España el Código Penal vigente regula esta materia los artículos 138 al 143:
"Art. 138 -El que matare a otro será castigado, como reo de homicidio, con la pena de prisión de 10 a 15 años.
Art.139 - Será castigado con la pena de prisión de quince a veinticinco años, como reo de asesinato, el que matare a otro concurriendo alguna de las circunstancias siguientes:
1.ª Con alevosía
2.ª Por precio, recompensa o promesa
3.ª Con ensañamiento, aumentando deliberada e inhumanamente el dolor del ofendido
4.ª Para facilitar la comisión de otro delito o para evitar que se descubra.
Art 140 - El asesinato será castigado con pena de prisión permanente revisable cuando concurra alguna de las siguientes circunstancias:
1.ª Que la víctima sea menor de dieciséis años de edad, o se trate de una persona especialmente vulnerable por razón de su edad, enfermedad o discapacidad
2.ª Que el hecho fuera subsiguiente a un delito contra la libertad sexual que el autor hubiera cometido sobre la víctima
3.ª Que el delito se hubiera cometido por quien perteneciere a un grupo u organización criminal
Art.143 - El que induzca al suicidio de otro será castigado con la pena de prisión de cuatro a ocho años"
In Spain, the current Criminal Code regulates this matter articles 138 to 143:
"Art. 138 - He who kills another will be punished, as a criminal of murder, with the penalty of imprisonment of ten to fifteen years.
Art.139 - Will be punished with the penalty of imprisonment of fifteen to twenty-five years, as a criminal of murder, who will kill another one of the following circumstances:
1st With treachery
2nd By price, reward or promise
3rd With cruelty, deliberately and inhumanly increasing the pain of the offended
4. To facilitate the commission of another crime or to prevent it from being discovered.
Art 140 - The murder will be punished with a reviewable permanent prison sentence when any of the following circumstances occur:
1. That the victim is under sixteen years of age, or is a person especially vulnerable because of their age, illness or disability
2. That the act was subsequent to a crime against sexual freedom that the author committed on the victim
3. That the crime was committed by whoever belongs to a group or criminal organization
Art.143 - He who induces the suicide of another shall be punished with the penalty of imprisonment of four to eight year

Estamos hablando de los delitos contra la vida más graves que existen, cuyas cifras se mantienen relativamente constantes en los últimos años: se estima que las víctimas pueden alcanzar unas 500.000 al año (si bien en muchos países no hay estadísticas fiables)

Y se cometen no solamente durante las guerras y conflictos armados, sino tambien en tiempos de paz; si incluimos las muertes producidas en zonas de guerra, las cifras pueden ser mucho mayores, y con frecuencia incalculables

Las causas o factores que provocan estos crímenes son muy variadas: terrorismo, robos, agresiones sexuales, secuestros, ajustes de cuentas, consumo y tráfico de drogas venganzas, racismo, ira, odio, celos, riñas en estado de embriaguez, enfrentamiento entre pandillas etc.

En lineas generales las regiones o países con mayores tasas de homicidios y asesinatos se encuentran situados en Africa y Centroamérica (incluyendo Brasil,Colombia,Venezuela y México) y los de menor incidencia se hallan en Europa, América del Norte y América del Sur
España tiene una tasa de criminalidad moderada/baja, similar a los demás países de la Comunidad Europea
The incidence is variable with respect to the different countries (see link at the end)

Para prevenir y combatir este y otros tipos de criminalidad parece importante - yo diria que imprescindible - erradicar la corrupción y el deterioro o desorden social así como dignificar, potenciar y revitalizar a los principales protagonistas de la lucha contra la delincuencia: Jueces, Fiscales, Policías, Oficiales y miembros de las Fuerzas Armadas, funcionarios de Prisiones, médicos forenses, psiquiátras, psicólogos, peritos forenses, etc.
To prevent and combat this and other types of crime it seems important - I would say essential - to eradicate corruption and social deterioration or disorder as well as to dignify, empower and revitalize the main protagonists of the fight against crime: Judges, Prosecutors, Police , Officers and members of the Armed Forces, Prison officers, forensic doctors, psychiatrists, psychologists, forensic experts, etc.
Todos estos funcionarios deben estar suficientemente remunerados y ha de atenderse a una buena formación y actualización profesional; deben crearse grupos policiales de investigadores especializados en terrorismo, homicidios, delitos sexuales, trafico de drogas, robos, fraudes, etc
Conviene igualmente que sus mandos o superiores jerárquicos ejerzan un control contínuo de inspección y corrección disciplinaria para atajar cualquier ilegalidad o negligencia en el servicio.

It is also advisable that their hierarchical superiors or supervisors exercise a continuous control of disciplinary inspection and correction to address any illegality or negligence in the service.
Igualmente es importante establecer servicios de inteligencia e información (recopilación informática de historiales y antecedentes, vigilancias, escuchas telefónicas, captacion de confidentes, etc) sobre homicidios y asesinatos llevados a cabo por bandas o grupos de delincuencia organizada, investigando sus modus operandi, conexiones entre ellas, utilización de sicarios, movimiento de dinero negro destinado a actividades ilegales, etc

Desde el punto de vista de la prevención general, en cada ciudad, hay que hacer estudios estadísticos sobre cuales son las zonas y horarios de mas incidencia delincuencial para potenciar una mayor presencia de patrullas policiales, asi como la instalación de cámaras de videovigilancia, vuelos de drones, mejor iluminación nocturna, etc.

Deben revisarse las normas penales y penitenciarias para establecer sanciones adecuadas que agraven las conductas más peligrosas, especialemte las que sean consecuencia de grupos criminales organizados, procurando que los condenados sean ingresados en centros específicos para atender no solo a la seguridad y cumplimiento, sin tambien a la reeducación y rehabilitación de los reclusos, en especial cuando se trate de menores de edad o de jóvenes adoelescentes.
The penal and penitentiary norms must be reviewed to establish sanctions that aggravate the most dangerous behaviors, especially those that are the consequence of organized criminal groups, trying that the condemned ones are admitted in specific centers to attend not only to the security and compliance, but also to the reeducation and rehabilitation of inmates, especially in the case of minors or young adolescents.
Asi mismo es conveniente llevar a cabo campañas de prevención en los medios de comunicación (TV, radio, prensa, Internet), asociaciones, centros escolares etc, para concienciar a la población sobre como debe actuar y reacionar ante los posibles delitos o agresiones
